USAG Humphreys Housing Office Realtor’s Guidelines 공인중개사 영업지침 서약서
The following are rules and/or guidelines to be adhered to by all realtors doing business with USFK personnel. They will be strictly enforced and any realtor violating any rule or guideline may face having restrictive sanctions taken against them. They will be sent to the Armed Forces Disciplinary Board (AFDCB) to determine off limit sanctions. If you have any question or concerns, please call the housing office.
다음은 주한미군기관의 군인 및 민간인을 상대로 부동산중개업을 하는 모든 공인중개사들이 충실히 지켜야 하는 규범과 영업지침입니다. 이러한 규범이나 영업지침을 위반하는 중개사무소에게는 엄격한 단속이 있을 것입니다. 위반할 경우 군기통제위원회에서 영업을 제한하는 벌칙여부를 결정할 것입니다. 질문이 있으시면 주택과에 문의하십시오.
1. The registered Realty Company must practice real estate in accordance with Korean Real Estate Laws and/or all Korean Laws concerning business practices. 주택과에 등록된 중개사무소는 대한민국 부동산중개업법이나 영업에 관계되는 대한민국 정부의 관계법을 성실하게 지켜야 합니다.
2. The realtors are not allowed to be involved in any unfair business practices such as: dishonest, corrupt or deceitful business practices: 공인중개사는 아래에 열거한 바와 같이 부정적, 비도덕적, 속이는 등의 부당한 상관습에 연관되는 것을 허용하지 않습니다.
a. Inflating prices based on the customer’s ability to pay. 입주자가 지불할 수 있는 능력 이상의 임대료를 부풀리는 행위. b. Offering “kickbacks or rebates” if customer signs a lease with you. 입주자에게 계약서를 작성할 시 사례금이나 뇌물을 제공하겠다고 현혹하는 행위. c. Contracting USFK personnel to help direct business to your company. 주한미군에 근무하는 당사자를 영업에 직접 동원하여 판매촉진하도록 이용하는 행위. d. “Bait and switch” tactics in showing rental properties. 임대물 건을 보여줄 때 “유인(미끼) 상술” 수단을 쓰는 행위. e. Passing out realtor’s business cards on military installation. 주한미군 부대 내에서 중개사무소 명함을 돌리는 행위.
No double lease contracts, no verbal agreements for additional rent payment from lessee. No writing additional amounts and/or adding special agreement amenities to lease contracts. Once lease contract is signed by all parties at USAG Humphreys Housing Office no changes or additions can be made to lease contract! 이중 계약서의 작성 금지/추가 월세 임대지불에 관한 구두 상의 계약금지

3. Realtors are responsible to ensure property does not have a mortgage over 60% of the value of the property and act in good faith in all negotiations between landlords and tenants. Any legal documentation, if necessary, must be submitted to the housing office for evaluation at no delay. Realtors are to ensure that all USFK personnel have been advised of their options to pay, on month to month basis on all rental properties listed in your office. 모든 공인중개사는 채권 최고액이 감정 평가서(또는 정부 공시가격)의 60%를 넘는 집을 중개하지 말아야 하며, 임대인과 임차인간의 모든 중개를 성실하게 해야 할 책임이 있습니다. 필요한 경우 평가를 위해서는 어떠한 법적인 서류라도 지체없이 주택과에 제출해야 합니다. 공인 중개사는 주한미군 소속 미군들이나 민간인들이 그들의 집세 지불에 대한 조건들이나 중개사무소에 열거된 임대 물건들이 매 달로 하는 것이 기본임을 알려주는 조언을 반드시 주도록 해야 합니다. 4. The realtors must provide an “English” speaking point of contact, available 24 hours a day, for their tenants to contact. This information must be submitted to the USAG Humphreys Housing Division on an annual basis. 5. Rent amounts must reflect the Fair Market Value (FMV) and will be subject to an inspection by a Housing Officer prior to showing the customer. 임대가격은 주택공정가를 반영한 것이어야 하며, 미군(민간인)에게 임대 물건을 보여주기 전에 안전검열을 받을수 있는 것이어야 합니다.
6. Changes on your staff, if any, must be reported and updated to the housing office within 5 days of change to doing business with USFK personnel. 험프리 주택과에 등록된 중개사무소의 중개보조원이 바뀌거나 어떠한 변경이 있을 때에는 바뀐때로부터 5일이내에 주택과에 업데이트된 내용을 통보해야 합니다.
7. Any realtor or any employee of a realtor who has a power of attorney for a property owner will sign his or her name (not the property owner’s name) and use his or her own stamp on any official U.S Army document (leases, receipt, etc.) A copy of the original power of attorney must be given to the USAG Humphreys Housing Office and a copy must be provided to the tenant. 공인중개사나 그 외 중개사무소에서 일하는 직원들이 임대인으로부터 위임을 받으면 수임자가 서명을 해야 하며, 미군 공식 서류(임대차계약서, 영수증, 기타 등)에 수임자의 도장을 사용하여야 합니다. 위임장 원본은 험프리스 주택과에 제출하고, 사본은 임차인에게 주어야 합니다.
Overall, the Humphreys Housing Office expects fair, honest, and ethical business practices from the realtors. If any realtor is caught performing unfair business practices, the realtor will be sent to AFDCB and subject to restrictive sanctions placed against him/her. Continued misconduct may result in permanent removal from the housing registration and working with USAG Humphrey’s personnel. 험프리 주택과에서는 공인중개사께서 종합적으로 공정하고, 정직하며, 도덕적인 상관습이길 기대하고 있습니다. 공인중개사께서 불공정한 상관습을 행하여 적발되면, 그 중개사무소는 주한미군 험프리 주택과와의 영업을 제한하는 제재를 받을 것입니다. 위법이 계속되면 험프리 주택과의 등록명단 및 험프리부대와의 영업이 영구적으로 제외될 것입니다.
